The Patent Meme


When I first started writing my patent law blog in 2003, there were maybe only one or two other blogs writing about patents. I know, it sounds crazy. Patent attorneys are the epitome of sex appeal. There had to thousands of bloggers fawning over patents and the like. I still have not figured it out.

Thankfully, five years and five hundred posts later, hundreds of blogs are covering patents and various patent related issues. Many have come, many have gone. There are lots of blogrolls out there, but almost all include non-patent related blogs or patent blogs which have not been updated for months.

So thinking the same thing you are obviously thinking, "If only I could have a link to all the important patent law blogs in one place" I started compiling a list of patent law blogs. Admittedly, I do not get out much. Well, fellow fans of all things Josh Weaton, the list is complete. What follows is my definitive patent meme. Definitive, of course until you kindly instruct me in colorful explicatives that no such list can possibly be complete sans your flatulence odor control patents blog. If I missed your favorite patent blog, or you would like to complain about one I included, feel free to leave a pithy comment.

Most Ridiculous Inventions Ever Patented


Cracked.com has just published their list of the 10 most ridiculous inventions ever patented. Of particular note, is Iowa's own Flat-D Innovations' flatulence pad.

Not to take anything away from Flat-D, which is quite wacky, but there are several inventions I feel should have made the list:

Artificial dog testicles

Apparatus for delivering a baby by centrifugal force.

The BoobieFlask (that is actually what it is called)

Sphincter training device (While I am not sure if my sphincter possesses the capacity to learn any tricks, I am fairly confident I have no desire to find out)

BlawgIT Makes New Friend at the Register

BlawgIT has made a new friend in Des Moines Register columnist Larry Ballard. Mr. Ballard's most recent WorkBytes column prominently features your humble narrator waxing philosophic on the wonders of all things patent. Mr. Ballard's column also quotes Everyday Edison's producer Michael Cable:

"Everyone either has had an idea for a new product or knows someone who has invented something," executive producer Michael Cable said. "Following through and executing is what trips up most inventors."

Free Money for Minority Inventors

One of the biggest concerns most inventors have when they come to their patent attorney for the first time is "Where to get the money to patent my invention?

Well, if you are an Iowa inventor, business attorney Rush Nigut has some priceless advice. Check out Iowa's Targeted Small Business Assistance which makes loans, and even equity grants, available for amounts up to $50,000 available to women and minority owned start-up companies.

Guy Kawasaki Hates Patents

Well, not really, but he does get tired of hearing about them. Ever since sharing the stage with Guy Kawasaki last month at IgniteIT and hearing his thoughts on patents, it seems like every time I turn around I have a Jungian/Guy Kawasaki plate o' shrimp patent moment. Just yesterday, Mike Sansone posted a video of Guy. The video is ostensibly on blogging, but Guy cannot help but throw in a word or two about patents. Just as he did at IgniteIT, Guy emphasizes the importance of not emphasizing patents when discussing your business plan with potential investors.

Guy is not opposed to patents, or any other intellectual property protection for that matter. He just subscribes to my philosophy; a patent is merely a "safe." The question is whether what you put inside is the Hope diamond or a lump of coal. If it is the Hope diamond, the product will evangelize itself. To borrow a phrase from Guy, "All you have to do is get out of the way." If what you have is a lump of coal, building Fort Knox around it is not going to help sell it and, therefore, is of little interest to potential investors.

Patents are important, but they are not going to change a sow's ear into a silk purse. The market either wants, or does not want, your product. Patents merely keep other people from competing with you. If your product is great, a patent is great, if your product is terrible, a patent is a waste of money. The tail does not wag the dog. Remember, anyone can get a patent on almost anything. Heck, I even have one myself.

Touting a patent to a potential investor is like saying you are incorporated. That is great, that is important, but what difference does it make? Tell me why your business plan is special. Tell me why the market will care. What in your business plan sets you apart? What special expertise does your team have? What is your experience in this industry? What customers are on board? What synergies, other than money, can this venture capital group bring to the table on your project?

Guy points out several valuable considerations in looking beyond patent protection. He also offers his patent lawyer buddies, Doug Sorocco Stephen Nipper and Matthew Buchanan the chance to counterpoint as well as offer some thoughts on other types of intellectual property protection like obtaining trademark registrations as a part of an overall branding strategy.

Guy's posts are a must read for any aspiring inventor. Patents are important, investors want to know you are pursuing them. However, making them the focus of your business plan is a sure fire way to tune out seasoned investors.

Iowa Inventor Patent Database

The State Library of Iowa has just launched the Iowa Inventor Patent Database on its website. The Patent Database includes the patents of over 75,000 Iowa inventors, covering the years 1843 until 2006. I just did a vanity check of my patent and the search appears to be working flawlessly. Thanks to Martha for the heads up on this great Iowa project.

MLK Day Post – African-American Inventors



In honor of Martin Luther King Day next Monday, I wanted to post a list of some famous African-American inventors and their patents. There obviously may be some disagreement as to who should, and who should not, make the list of famous African-American inventors. I have tried to include not only those who have contributed to mankind as a whole, but also those African-American inventors we know from other endeavors, or from the fun things they have brought to our lives. If you take issue with any of my selections, I have provided a small bucket of sand in the reception area of our offices which you are free to stop by and pound if you wish.

And with that introduction - here is the list:

10) Michael Jackson

In 1993, singer and entertainer Michael Jackson received a patent on a novel shoe, The shoe includes a cut-out in the heel, which an entertainer slides on and off a nail head in the stage. The nail head grabs the heel and allows the entertainer to perform apparently gravity defying leans.

9) Lonnie G. Johnson

President of Johnson Research & Development Co. Lonnie Johnson holds over 20 patents. His patented SuperSoaker squirt gun has generated over $100 million in sales.

8) Lewis Latimer


Everyone knows Thomas Edison invented the light bulb, but few know that it took African American inventor Lewis Latimer to come up with the carbon filament that made it practical. Edison’s original draftsman, Latimer drafted the plans for Alexander Graham Bell’s telephone. Latimer worked late nights with Bell to file a patent on Bell’s telephone mere hours before the filing of a patent by a rival inventor.

7) Elijah McCoy

Elijah McCoy patented dozens of devices and methods for lubricating machinery. Especially useful were his inventions for lubricating machinery while it was running, including a novel oil dripping cup. While others tried to copy McCoy’s cup, nothing worked as well as the original. That is why, even today, we ask for “the real McCoy”

6) Dr. Joycelyn Simpson

As a research scientist for NASA’a Langley Research Center, Dr. Simpson invented a new type of high performance piezoelectric polymers. When pressure is applied to these polymers, the polymers generate electricity. Utilizing these polymers in conjunction with wind and water power may lead to an unlimited, low-cost, environmentally friendly source of power.

5) Dr. Patricia E. Bath

Born in Harlem, internationally acclaimed ophthalmologist and surgeon, Dr. Bath has dedicated her life to the prevention and treatment of blindness in African-Americans. Her laser-powered Laserphaco Probe vaporizes and fragments cataracts in minutes.

4) James Edward West

The research of James Edward West Ph.D. led to the development of the foil-electret transducers used in 90% of today’s microphones. James West holds over 40 patents on microphones and their components and is a 1999 inductee into the National Inventors Hall of Fame. In 1964, West patented the electret microphone while working at Bell Laboratories.

3) Percy Julian

Awarded over 100 patents Percy Julian was most well known for his innovative synthesis of cortisone from soy beans. His inventions significantly reduced the cost of cortisone which is used to treat rheumatoid arthritis and inflammation. Julian is a 1990 inductee into the National Inventors Hall of Fame.

2) Mark Dean

Holder of more than 20 patents, Mark Dean, along with Dennis Moeller, created a computer bus system for controlling the use of computer peripherals like disk drives, video monitors, printers, speakers, and scanners. Dean holds three of the original nine IBM patents on the personal computer. IBM granted Dean an IBM Fellowship in 1996 and, a year later, Dean received the Black Engineer of the Year President’s Award. Dean is a 1997 inductee into the National Inventors Hall of Fame.

1) George Washington Carver

Despite inventing hundreds of novel products and methods for improving agriculture, George Washington Carver, patented only a handful. Born a slave, Carver consistently shunned fortune, taking no money at all for the majority of his inventions, in pursuit of mankind’s greater good. Granted a scholarship in Kansas, the college refused Carver admission when they discovered he was African American. Carver enrolled at Simpson College in Indianola, Iowa before enrolling the following year in what is now Iowa State University. Carver is a 1988 inductee into the Iowa Inventor’s Hall of Fame and a 1997 inductee into the National Inventors Hall of Fame
